Home Owners Associations- What You Need to Know

Florida Home Owners Associations.

You either love them or hate them. Some are more restrictive than others. The main purpose for establishing a homeowners association was to insure conformity much like deed restrictions. Some require filing the color codes for exterior paint colors on homes for instance, others require fences if permitted at all need to conform to a certain height, use only certain fencing materials, may or may not be wood and if they are only certain stain colors may be permitted. These are all examples of conformity.

In addition, there are other restrictions. When the roof may need to be cleaned. How tall the grass can be, or what type of shrubs can be planted. How many cars one can be parked and where parking is permitted. Boats most do not want them in driveways, they must garaged and vehicles with signs are often not allowed.

Most HOA’s do not allow for home businesses. There may also be restrictions governing Business vehicles, vehicles with signs on them (even magntic ones) Rules pertaining to parking in the drive. Boat. Recreation vehicles.

Enforcing conformity.

The original purpose of Home Owners Associations. It used to mean discouraging the auto enthusiast from changing his oil in the driveway. Now in the electronic age, means “operating” a web based business inside the home. Granted no one here is arguing that children should NOT be protected from lude and lascivious behaviors. That is excluded for the purposes of this discussion.

So the question here is: If people are considerate neighbors and zoning enforcement is in place do we really need a Home Owners Association to dictate what we can or cannot do?

Added Note: Some also restrict the use of For Sale Signs- sellers are discovering how this policy impedes their ability to sell their homes. Buyers are encouraged to find out specific restrictions before purchasing a home in a community with an Home Owners Association so that you have all the imformation in advance.
